The agreement that governs your use of LearnHouse.
Welcome to LearnHouse. These Terms of Service (the "Terms") are a binding agreement between you and LearnHouse ("LearnHouse", "we", "us" or "our") and govern your access to and use of the LearnHouse website at learnhouse.app, our hosted learning platform, and related services (together, the "Service").
By creating an account, clicking to accept, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
The Service is operated by LearnHouse, a company incorporated in Delaware, United States. LearnHouse is also available as open-source software that you may self-host; when you self-host, your use is governed by the applicable open-source license and not by these Terms (see "Open source and self-hosting" below).
You must be at least 16 years old, or the age of digital consent in your country, to create an account. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly at hello@learnhouse.app if you suspect any unauthorized use. You are responsible for the acts and omissions of anyone you invite to your workspace or grant access to.
LearnHouse lets you create, host, and sell courses and other learning content. We offer a free plan and several paid plans with different limits and features, as described on our pricing page. We may add, change, or discontinue features over time. We will try to give reasonable notice of material changes that reduce core functionality of a paid plan.
Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method for the plan fees and applicable taxes on each renewal until you cancel.
You retain all ownership of the courses, media, text, and other materials you or your users upload or create on the Service ("Your Content"). We do not claim ownership of Your Content.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for formatting and display), transmit, and display Your Content solely as needed to operate, secure, and improve the Service and to provide it to you and the learners you designate. This license exists only for as long as you keep Your Content on the Service, and ends when you delete it or close your account, except for residual backup copies kept for a limited period or as required by law.
You are responsible for Your Content and represent that you have all rights necessary to upload it and grant the license above, and that Your Content does not infringe any third party's rights or violate any law. We do not pre-screen Your Content, but we may remove content that we reasonably believe violates these Terms or the law.
If you use the Service to sell courses or accept payments from your learners, those payments are processed through Stripe using your own connected Stripe account. As between you and LearnHouse:
If you are a learner buying a course, your purchase is with the creator who sells it, and any questions about access, refunds, or the course itself should be directed to that creator.
You agree not to, and not to allow others to:
If you believe content on the Service infringes your copyright, contact us at hello@learnhouse.app with enough detail to identify the work and the material, and we will respond to valid notices and may remove infringing content and terminate repeat infringers.
The Service itself, including the LearnHouse software, design, and brand, together with all related intellectual property rights, is owned by LearnHouse and its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the hosted Service for your internal business or personal purposes during your subscription. The LearnHouse name and logo may not be used without our permission, except as allowed by the open-source license for self-hosted use. We welcome feedback, and you agree we may use any feedback you provide without obligation to you.
Unless you tell us otherwise, you grant us the right to use your name, logo, and workspace or school name to identify you as a LearnHouse customer on our website, in presentations, and in other marketing and promotional materials. We will use your marks in a way that is not misleading and consistent with any brand guidelines you provide.
You can opt out at any time by emailing us at hello@learnhouse.app, and we will stop using your marks in new materials within a reasonable time. This section does not permit us to state or imply your endorsement of any specific product claim without your consent.
The Service integrates with third-party services (for example Stripe for payments, and analytics or AI providers). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. If a third-party service changes or becomes unavailable, related features of the Service may be affected.
LearnHouse's source code is available under its published open-source license. If you download and self-host LearnHouse, your rights and obligations for that software are set by that license, not by these Terms, and the hosted Service warranties, support, and paid features described here do not apply to self-hosted installations. These Terms govern only your use of the hosted Service we operate at learnhouse.app.
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay, or use the Service in a way that creates legal risk or harm to us or others; where practical and not urgent, we will give you notice and a chance to fix the issue first.
On termination, your right to use the Service ends. You may export Your Content before your account closes; after a reasonable period following termination, we may delete Your Content. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your requirements. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, data, or goodwill, arising out of or relating to the Service, even if advised of the possibility of such damages.
Except for your payment obligations and your indemnification obligations, each party's total liability arising out of or relating to these Terms and the Service will not exceed the greater of (a) the total fees you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) one hundred US dollars (US $100). Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for gross negligence, willful misconduct, or fraud.
You agree to defend, indemnify, and hold harmless LearnHouse and its officers, employees, and agents from any claims, damages, liabilities, and reasonable costs (including legal fees) arising out of or related to Your Content, your sales to learners, your use of the Service, or your breach of these Terms or of any law or third-party rights.
We may update these Terms from time to time. If we make material changes, we will notify you by email or in the Service where appropriate. Changes take effect when posted, and your continued use of the Service after that means you accept the updated Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and LearnHouse agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not subject to another agreed process, and each party consents to venue there. If any provision of these Terms is found unenforceable, the rest remains in effect.
We use cookies to operate and improve the Service. By using LearnHouse, you agree to our use of cookies as described in our Privacy Policy.
